Terms of Use

  1. General Information
    These Terms of Service ("Terms") constitute a legally binding agreement between you ("User”) and the Automated Permanent Academic Account Registry (APAAR), a service provided by the Ministry of Education, integrating with Academic Bank of Credits (hereafter referred to as the “ABC”), established by the Ministry of Education and University Grants Commission (hereby referred to as “MoE” and “UGC” respectively), implemented by Digital India Corporation (DIC), Ministry of Electronics and Information Technology (MeitY).

    Please read these Terms carefully before accessing or using APAAR. By accessing or using the APAAR platform, users acknowledge and agree to the Terms & Conditions outlined herein.
  2. Definitions
    Unless the context otherwise requires, the terms shall mean as under:-
    (a) “ABC” : means Academic Bank of Credits established by the Ministry of Education.
    (b) “APAAR” : means Automated Permanent Academic Account Registry, a product of Ministry of Education, integrated with Academic Bank of Credits.
    (c) “DIC” : means Digital India Corporation.
    (d) “Force Majeure” : means an Act beyond the reasonable control of APAAR.
    (e) “IPR” : means Intellectual Property Rights.
    (f) “MEITY” : means Ministry of Electronics and Information Technology.
    (g) “MOE” : means Ministry of Education.
    (h) “Services” : means the services being rendered by APAAR to its Users.
    (i) “Terms” : means the terms and conditions governing the use of APAAR system.
    (j) “UGC” : means University Grants Commission.
    (k) “PEN” : means Permanent Education Number.
    (l) “UDISE” : means Unified District Information System for Education Plus.
  3. Acceptance of Terms
    By accessing and using the APAAR platform, Users unconditionally accept that you have read, understood, and agree to be legally bound by these terms and conditions. If you do not agree with the stipulated terms and conditions, you are not allowed to use/ access the website and its services. The Ministry of Education reserves the right to update or modify these Terms at any time without prior notice, however, you shall be notified about the new updated policy and its terms. Your continued access to the services, shall signify your acceptance to the updated terms and policy.
  4. Termination of this Agreement
    APAAR reserves the right, at any time, to modify or discontinue, temporarily or permanently, the Services (or any part of it), with or without notice. APAAR in its sole discretion reserves the right to suspend or terminate any user account and refuse any current or future use of the Site for any reason at any time, which includes (but is not limited to i.) requests by law enforcement or other government agencies and ii.) discontinuance or material modification of the Site or any service offered on or through the Site. Such termination may result in the deactivation or deletion of the account, and the loss of all the content hosted therein.
  5. Scope of Services
    The Automated Permanent Academic Account Registry (APAAR) ID is introduced as a pivotal component by Ministry of Education. The APAAR ID embodies the vision of “One Nation, One Student ID”, ensuring a unified and accessible academic experience for students across India. The APAAR ID serves as a lifelong academic passport, consolidating all achievements and credentials of a student in one place.
  6. User Registration
    To access APAAR, the student/learner must validate/ authenticate an account and provide accurate, current, and complete information during the registration/authentication process. Users are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Any unauthorized use or security breach must be promptly reported to the department.
  7. Student Participation
    Students should ensure that they authenticate themselves with the APAAR portal. To avail the benefits of APAAR, users must also present their APAAR ID to the ABC nodal officer. In addition, students who transfer to other academic institutions should make sure that their ABC ID is submitted to the nodal person regularly so that credit can be accrued under the ABC Ecosystem. ABC will not accept credit course documents directly from students and will only consider them genuine after being provided by the appropriate, registered academic institutes granting the credit.
  8. User Submissions
    Users acknowledge that they themselves are solely responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential. By linking your Aadhaar number to your APAAR account, you grant APAAR, permission to use your unique identifier information for authentication and to retrieve your verification data from the UIDAI servers in order to provide the APAAR service.

    Users agree to furnish with information concerning any errors, problems, difficulties, or suggestions regarding the access to or use of the Site. You will also promptly respond to any reasonable questions raised by APAAR.

    Users agree and undertake not to circumvent any restrictions placed by APAAR on access to the Services. You further permit APAAR to monitor your use of the Site to ensure compliance with the terms.
  9. Permitted Access
    You will only access (or attempt to access) the APAAR platform if you’re above 18 years of age or under the supervision of parents/ guardian and in compliance with these Terms. In addition, you will comply with all Central and State laws, rules, and regulations applicable to you and your use of the Site and affecting any third-party rights. APAAR grants the users, solely for their personal use, a limited, non-exclusive, non-transferable, non-sub licensable, revocable license to access and use the Site.
  10. User's Conduct
    The Users agree not to use the APAAR Services and Websites:
    1. The User shall not use the APAAR Services/ Websites to decompile, reverse engineer, disassemble, rent, lease, loan, sell, sublicense, copy, modify, reproduce, republish, distribute, display, or create derivative works from APAAR.
    2. The User shall not use any network monitoring or discovery software to determine the site architecture, or extract information about usage, individual identities or users.
    3. The User shall not use any robot, spider, other automatic software or device, or manual process to monitor or copy APAAR without our prior written permission. Any unauthorized use of APAAR is prohibited. The use of any software (e.g., bots, scraper tools) or other automatic devices to access, monitor or copy the website pages is prohibited unless expressly authorized by APAAR in writing.
    4. The User shall not use the Site or any Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of APAAR or others.
    5. The User shall not post, use or transmit Content that you do not have the right to post or use, for example, under intellectual property, confidentiality, privacy or other applicable laws.
    6. The User shall not post, use or transmit Content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or otherwise interfere with or disrupt the Site or Service or servers or networks connected to Site or Service, or that disobeys any requirements, procedures, policies or regulations of networks connected to the Sites or Services.
    7. The User shall not post or transmit Content that is harmful, offensive, obscene, abusive, invasive of privacy, defamatory, hateful or otherwise discriminatory, false and misleading, incites an illegal act, or is otherwise in breach of your obligations to any person or contrary to any applicable laws and regulations; intimidate or harass another.
    8. The User shall not use or attempt to use another’s account, service, or personal information.
    9. The User shall not remove, circumvent, disable, damage or otherwise interfere with any security-related features that enforce limitations on the use of the Site or Services.
    10. The User shall not attempt to gain unauthorized access to the Site or Services or to accounts, computer systems or networks connected to the Sites or Services, through hacking password mining or any other means or interfere or attempt to interfere with the proper working of the Site or Services or any activities conducted through the Sites or Services.
    11. The User shall not use any means to bypass or ignore robot.txt, or other measures we use to restrict access or use of the Site or Services.
    12. The User shall not impersonate another person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; and post or transmit any personally identifiable information about other users.
  11. Academic Records and DigiLocker Integration
    Students should ensure that they authenticate themselves with the APAAR portal. To avail the benefits of APAAR, users must also present their APAAR ID to the ABC nodal officer. In addition, students who transfer to other academic institutions should make sure that their ABC ID is submitted to the nodal person regularly so that credit can be accrued under the ABC Ecosystem.   12. Student Participation
    Users understands and acknowledges that APAAR integrates with DigiLocker, a secure platform for electronic storage, and sharing of your documents and certificates. The key features of the site include but are not limited to, the creation of DigiLocker accounts, storing and sharing of government-issued or other documents, and Uniform Resource Identifiers (URI) with different public or private organizations. By linking your Aadhaar number to your DigiLocker Account, user grants DigiLocker permission to use your Aadhaar information and to retrieve your eKYC data from UIDAI servers to provide DigiLocker Services.

  13. Academic Bank of Credits Integration
    User understands and acknowledges that APAAR collaborates with the Academic Bank of Credits to track and manage academic credits earned by users. The integration ensures the accurate representation of academic achievements and facilitates seamless credit transfers. Users can view and manage their academic credits through the ABC portal.
  14. Indemnity
    The Users agree to indemnify and hold harmless the APAAR, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates from and against any and all losses, expenses, damages, and costs, including without limitation reasonable attorney’s fees, resulting, whether directly or indirectly, from:
    1. your use of and access to the Site and Services.
    2. your violation of any term of this Agreement.
    3. your violation of any laws or regulations or any third party right, including without limitation, any copyright, property, or privacy right.
  15. Data Protection and Security
    The Ministry of Education is committed to protecting your information. By using APAAR, you agree to the collection, processing, and storage of your academic data in terms of the privacy policy. The Ministry follows industry-standard security measures to safeguard your information. For more details, please refer to the Privacy Policy available on the APAAR platform.
  16. Usage Restrictions
    You agree not to misuse APAAR, including but not limited to attempting to gain unauthorized access, interfering with the proper working of APAAR, or violating any applicable laws or regulations. The Ministry reserves the right to terminate your account and pursue legal action for any such misuse.
  17. Accuracy of Content
    While every effort has been made to ensure the accuracy of the content on the APAAR platform, it should not be construed as a statement of law or used for any legal purposes. Users are advised that the content provided is for informational purposes only. In case of any ambiguity or doubts, users are strongly encouraged to verify and cross-check information with the Department and/or other authoritative sources. It is advisable to seek appropriate professional advice when in doubt.
  18. External Links (Hyperlinks)
    The Site may contain links to other websites not controlled by APAAR (“Third Party Websites”), as well as content belonging to or originating from persons or organizations other than APAAR (“Third Party Content”). These links are provided for your convenience only and APAAR has no control over such content.

    You acknowledge that APAAR is not responsible or liable for any Third-Party Websites or any Third-Party Content, information or products made available at any Third-Party Website, in any manner whatsoever. APAAR shall not be liable to anyone, in any way for any content or materials of any third parties, including but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.
  19. Intellectual Property Rights
    You acknowledge and agree that the Service may contain content or features (“Service Content”) that are protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. Except as expressly authorized by APAAR, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Service Content, in whole or in part, except that the foregoing does not apply to Members for their own User Content that you legally upload to the Service. In connection with your use of the Service you will not engage in or use any data mining, robots, scraping or similar data gathering or extraction methods. The technology and software underlying the Service or distributed in connection therewith are the property of APAAR, our affiliates and our partners. You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software. Any rights not expressly granted herein are reserved by APAAR. The name and logos are trademarks and service marks of APAAR (collectively the “APAAR Trademarks”). Other company/ organisation’s, product, and service names and logos used and displayed via the Service may be trademarks or service marks of their respective owners who may or may not endorse or be affiliated with or connected to APAAR. Nothing in this ‘Terms of Service” should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of APAAR Trademarks displayed on the Service, without our prior written permission in each instance. All goodwill generated from the use of APAAR Trademarks will inure to our exclusive benefit.
  20. Termination
    The Ministry of Education reserves the right at any time to modify or discontinue, temporarily or permanently, the service with or without notice. The ministry in its sole discretion reserves the right to terminate or suspend your access to APAAR at any time, with or without cause, and with or without notice.
  21. Legal Disclaimer
    The information provided on the APAAR platform is not intended as legal advice. Users should not rely solely on the content for legal decision-making. If legal advice or clarification is needed, users are urged to consult with the Department or seek guidance from other qualified professionals.
  22. Arbitration & Dispute Resolution
    Any differences or disputes arising out of in connection with the terms including any question regarding its existing, validity or termination shall be resolved mutually by the parties. However, in the event of non-resolution, the matter shall be referred to arbitration, of a sole arbitrator. The arbitration proceedings shall be governed by Arbitration and Conciliation Act 1996 as amended from time to time. The language of arbitration proceedings shall be English and the seat and venue of arbitration shall be New Delhi.
  23. Governing Law & Jurisdiction
    These Terms are governed by and construed following the Indian Law. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of New Delhi, India only.

  25. Force Majeure
    APAAR is not responsible if it doesn't meet any of its responsibilities under the Agreement or offer the services or any part of them if the performance is stopped, slowed down, or postponed by a Force Majeure Event and if its commitments are put on hold for the period as the Force Majeure Event lasts. "Force Majeure Event" refers to a situation that is beyond a party's reasonable control. This incorporates, but is not limited to, the failure of any communication system, a breach or malware in the systems, fire, explosion, flood, acts of God, civil unrest, riots, rebellion, war and acts of government.
